These Official Rules govern the conduct of the Raffle. By purchasing a raffle ticket, you agree to be bound by these Official Rules.
 Download Flyer/Rules GENERAL INFORMATION Five Acres – The Boys’ and Girls’ Aid Society of Los Angeles County ("Five Acres"), a 501(c)(3) not-for-profit California corporation, will be holding a raffle under California Raffle Registration Number: R-1130. The net proceeds from the raffle will be used by Five Acres to provide support for its child abuse prevention, treatment and education services and programs. The raffle drawing will take place during the Five Acres Annual Meeting at The Athenaeum on Tuesday, March 3, 2009 and the winner will be announced at that time. Five Acres is conducting this drawing and is located at 760 West Mountain View Street, Altadena, California 91001-4996.
TICKETS Raffle tickets are $50 each, or 6 for $275 in a single purchase. Payments for raffle tickets may be made by check or credit card. Checks shall be made payable to “Five Acres.” Checks returned by the bank shall automatically disqualify the entrant. No more than 1,000 tickets will be sold. Raffle tickets will be entered into the drawing on a first-come first-served basis in the order received by Five Acres. Completed Ticket Request Forms must be accompanied by valid payment to be eligible. Any Ticket Request Forms received with payment after 1,000 tickets have been sold will be returned. No other refunds are available. Only one name may be entered on a ticket. Division of a prize by a group purchasing a ticket shall be the sole responsibility of the person named as the winner. Altered tickets will be automatically disqualified. Retain your raffle stub. In the event of a dispute concerning the winner of the drawing, you will be required to show a raffle ticket stub. Five Acres assumes no responsibility for lost, late, misdirected or non-delivered mail or other failure to deliver tickets prior to any deadline. Purchases of raffle tickets are not tax-deductible contributions.
HOW TO PURCHASE Tickets may be purchased by mail to: Five Acres, 760 West Mountain View Street, Altadena, California 91001-4996; by fax at (626) 585-1789; or by phone to (626) 798-6793 ext. 2244. An official Ticket Request Form may be obtained at www.fiveacres.org.
ELIGIBILITY You must be 18 years of age or older, and have a tax identification number to purchase a raffle ticket or win a prize. Tickets may be purchased only by California residents. Employees of Five Acres, its officers, board members and volunteers are eligible to participate. Individual(s) drawing and announcing the winning tickets are not eligible to win a prize. Void where prohibited by law.
SELECTION OF WINNER Winning ticket for the Grand Prize will be drawn at random on March 3, 2009 at the Five Acres Annual Meeting from all eligible raffle tickets entered. Ticket purchaser does not have to be present to win. Odds of winning a prize will depend on the number of raffle tickets sold. If all 1,000 tickets are sold, the odds of winning the Grand Prize will be 1 in 1,000.
Winner will be notified within 5 days of the drawing by email, telephone or in writing by Certified Mail and provided the requisite procedure to claim the prize. All contact attempts shall be made to the electronic address, phone number or street address provided by the raffle entry purchaser.
If any winner cannot be located by 5:00 pm PST, March 24, 2009, after making reasonable attempts to do so, or if the winner is deemed to be ineligible, such winner will be deemed to have forfeited his or her prize and another winner will not be selected for such prize. Winning name may be obtained by writing to Five Acres. Requests in writing must be received between March 30 and April 22, 2009.
All winners authorize Five Acres to publish their name and likeness on its website and to use them in other promotional materials without compensation.
PRIZES GRAND PRIZE: The Grand Prize is a 2009 Audi A4 with an estimated value of $34,800.** Grand Prize winner can select the color based on availability. Grand Prize winner is responsible for the cost of any upgrades or additional accessories beyond those specified. To review the standard features and specifications of the 2009 Audi A4, please refer to the 2009 Audi A4 brochure on our website at www.fiveacres.org.
A minimum of 725 tickets must be sold for the Grand Prize to be the 2009 Audi A4. If fewer than 725 tickets are sold prior to 7:00 pm PST, March 3, 2009, the raffle will be held as scheduled however the Grand Prize winner will receive a 50% share of the net raffle proceeds. Net proceeds are defined as the balance of funds left after paying all raffle expenses. Net proceeds will be divided evenly between Five Acres and the Grand Prize winner, less appropriate and required federal taxes.
**All winnings will be reported to the IRS and the state of California based on the applicable laws in place at the time of the drawing and the winner must pay any applicable withholding taxes. Currently, the IRS requires that income tax withholding on prize values of $5,000 or greater must be paid upon award and distribution. Government rules governing withholding can change without notice.
Grand Prize winner is responsible for any and all state or local taxes, license, title, tags and registration or any other fees associated with the vehicle. Grand Prize winner must show proof of his or her valid state driver’s license and proof of insurance. Grand Prize winner is responsible for transporting the vehicle from Rusnak Audi Pasadena, California to Grand Prize winner’s residence. Date of transaction to claim the vehicle must be coordinated with the Grand Prize winner, Rusnak Audi Pasadena and Five Acres. Grand Prize winner will be required to complete and sign associated documents as determined by Five Acres and Rusnak Audi Pasadena dealership to claim his or her prize. Rusnak Audi Pasadena makes no representations or warranties as to the prize vehicle. Rather, the winner will receive the warranties provided by the manufacturer. Rusnak Audi Pasadena has partnered with Five Acres as an accommodation and in order to support the mission of Five Acres, and is neither a co-venturer nor an agent of Five Acres.
All travel and any other expenses related to fulfilling a winning prize are solely at the expense of the winner.
GENERAL TERMS AND CONDITIONS By purchasing a raffle ticket, you agree to be bound by these Official Rules and the decisions of Five Acres, which shall be final. All winners are required to present proof of identity satisfactory to Five Acres, in Five Acres’ sole discretion, matching the name on the winning ticket. By entering and by the winners accepting a prize, entrants agree to follow the Official Rules and hold harmless and indemnify Five Acres and each of its respective directors, officers, employees, volunteers, Rusnak Audi Pasadena and agents against any and all liability, damages or causes of action (however named or described) with respect to or arising out of either (i) the entrant’s participation; or (ii) the receipt or use or misuse of the prize(s) awarded in the raffle. Entrants will not hold Five Acres or Rusnak Audi Pasadena dealership responsible or liable for any or all accidents, thefts or damages resulting by their participation in this event. The Grand Prize winner further acknowledges that Five Acres and each of its respective directors, officers, employees, volunteers, Rusnak Audi Pasadena dealership and agents have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness and also acknowledge that they did not receive any representations, warranty or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness.
Five Acres reserves the right to modify or amend these Official Rules without notice at any time.
